Defects

Section 558, Florida Statutes governs construction defects in Florida. It requires the property owner give written notice of the claim to the potentially responsible party (contractor, subcontractor, etc.) before filing suit. It also provides an opportunity for settlement and gives the potentially responsible party the ability to offer to settle in the form of repairs or monetary payment prior to filing suit. The requirements of this statute can be confusing and potentially waived contractually.
