How is Spousal Support Calculated?
There are no solid guidelines for the calculation of alimony. It is based on two factors: One spouse's need for financial support and the other spouse's ability to pay financial support.
Need is largely based on the marital standard of living. Essentially, the goal is to maintain a similar standard of living after divorce. Alimony may be required to do so.
Ability to pay is, of course, based on income. Consideration may be given when that income was saved instead of being spent to create a high standard of living during the marriage. This is one example of where these matters get complex. Our experience means we can sort through all complexities.
